IMPORTANT — EARLY ACCESS / BETA
The Game is provided as early access/beta. Features may change or be removed; servers may be unavailable; progression, inventories, ratings, and accounts may be reset at any time. There is no monetization at this time. If monetization is introduced later, we will notify and any purchases will be processed by the relevant Platform under its policies.
By installing/playing, you agree to the Miiridian Prime Code of Conduct (in-game text link and www.miiridianprime.com/code-of-conduct) and the Privacy Policy (in-game text link and www.miiridianprime.com/privacy).
You can link/unlink platform accounts and request account deletion via our Account Hub (in-game text link and https://link.miiridianprime.services/).
1) Platform Terms; Privacy; No Reliance
Your use also follows PlayStation™Network, Steam®, Apple App Store (iOS), or Google Play (Android) (each a “Platform”) terms/policies. If there is a conflict, Platform terms control only for that Platform. Our Privacy Policy applies (see link above). You acknowledge no reliance on roadmaps/marketing beyond this Agreement.
2) License
We grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use one (1) copy of the Game on compatible devices you own/control for personal, non-commercial entertainment. The Game is licensed, not sold. No transfers unless expressly allowed by this Agreement and Platform terms.
3) Content; Streaming; No UGC
We and our licensors own all rights in the Game and its content.
No UGC Features. The Game currently does not provide user-generated content features (e.g., chat, custom levels/assets, or uploads). If we later enable UGC, we will update these terms to include applicable licenses and rules.
Virtual Items (no cash value). Any in-game items, currency, cosmetics or progression states have no cash or property value, are not redeemable or refundable for money or monetary value, and may be modified, limited, or removed at any time.
Streaming. Non-commercial capture/stream is permitted subject to this Agreement and Platform rules; we may restrict certain segments.
DMCA / Copyright & IP Complaints (Global). If you believe content in the Game (including names, images, captures/streams, or other materials) infringes your rights, email legal@moonray.studio with: (i) your contact details; (ii) the work/right claimed; (iii) the material and its location; (iv) a good-faith statement the use is unauthorized; (v) a statement that the notice is accurate and, under penalty of perjury, you are the rightsholder or authorized agent; and (vi) your signature. If content was removed in the U.S. under the DMCA and you believe it was a mistake, you may send a counter-notice including: (i) your contact details; (ii) identification of the removed material and its prior location; (iii) a statement under penalty of perjury that the removal was a mistake or misidentification; and (iv) a statement consenting to the jurisdiction of the Federal District Court for the District of Delaware and to service from the complainant. We may remove/disable access to disputed content and, where appropriate, restrict accounts of repeat infringers.
4) Cross-Play, Cross-Progression, Linking
Cross-Play. Online play with other Platforms may be available; you may disable cross-play (where offered), which can affect matchmaking/features.
Cross-Progression. Progress may sync via account linking only where technically and contractually permitted. Entitlements/purchases from one Platform may not be usable on others.
Linking/Deletion. Manage links and request account deletion via https://link.miiridianprime.services/. Deletion is irreversible and may remove access to progression/entitlements not stored by a Platform.
Beta Resets. During beta, progression/inventories/ratings/accounts may be reset.
5) Updates; Service Changes; Support
We may push updates required to continue playing (may auto-install). We may change, suspend, or discontinue any feature, leaderboard, matchmaking logic, or the Game itself at any time with or without notice. We have no obligation to provide maintenance or support except where required by law or Platform policy.
6) Eligibility; Online Safety; Health
Eligibility; No Moonray Child Accounts. You must be at least 13 years old. If you are under the age of majority in your jurisdiction, a parent or legal guardian must review and accept this Agreement on your behalf. We do not offer or operate Moonray-managed child accounts. Platform parental controls (e.g., on PlayStation, Apple, Google) may limit online features and are administered by the Platform.
Online Safety. You must follow our Code of Conduct and applicable Platform community rules. Violations may lead to warnings, feature limitations, suspension, or termination. In-game report tools may be provided; appeals via support@moonray.studio.
Health. The Game may include flashing lights or patterns that could trigger photosensitive epilepsy or other conditions. Stop if you experience adverse symptoms. See PlayStation Health Warning: https://www.playstation.com/legal/health-warning/
7) Purchases & Cross-Commerce (Beta State)
No paid IAP or paid virtual currency is available at this time. If monetization appears later, transactions are processed by the relevant Platform under its policies; refunds follow Platform policies and non-waivable law.
PlayStation entitlements are licensed for use on PlayStation platforms only and are not transferable to other platforms unless explicitly permitted by Sony Interactive Entertainment and supported by our systems. Similar restrictions may apply on Apple, Google Play, and Steam in line with their policies.
8) Acceptable Use; Anti-Cheat
You will not (and will not help others to) reverse engineer except as allowed by law; bypass security; use cheats/bots/exploits/automation; interfere with servers/users; commercialize without permission; violate law/Platform terms; access accounts/systems without authorization; or engage in fraud.
Anti-Cheat. While running, the Game may perform integrity checks and detect/report suspected unauthorized programs/modifications to protect gameplay integrity. Uninstall to stop such monitoring.
9) Third-Party Services
The Game may rely on or link to third-party services/content. We are not responsible for them; your use is at your own risk and may be subject to additional terms.
10) Suspension; Termination
We may suspend or terminate your account/access at any time, with or without notice, including for suspected violations. On termination, your license ends and you must stop using and delete all copies. You are not entitled to compensation/refunds for progression, ratings, or virtual items/features.
11) Disclaimers (Maximum Permitted)
THE GAME AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” ESPECIALLY DURING BETA. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS, IMPLIED, OR STATUTORY), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SATISFACTORY QUALITY, ACCURACY, AND QUIET ENJOYMENT; NO GUARANTEE OF UNINTERRUPTED/ERROR-FREE OPERATION, SECURITY, DEFECT CORRECTION, DATA RETENTION, FAIR MATCHMAKING, OR CONTINUOUS AVAILABILITY OF ANY FEATURE, VIRTUAL ITEM, PROGRESSION, OR SERVER. Nothing here limits non-waivable statutory warranties or consumer rights that apply to you under applicable law.
12) Limitation of Liability; Time Limit
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA/GOODWILL/PROFITS/BUSINESS; OR SERVICE INTERRUPTION/DEVICE DAMAGE, ARISING OUT OF OR RELATED TO THE GAME OR THIS AGREEMENT.
OUR TOTAL AGGREGATE LIABILITY TO YOU WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNTS YOU PAID US FOR THE GAME OR VIRTUAL ITEMS IN THE SIX (6) MONTHS BEFORE THE EVENT (IF ANY). ANY CLAIM MUST BE FILED WITHIN ONE (1) YEAR AFTER IT ACCRUES, OTHERWISE IT IS PERMANENTLY BARRED, UNLESS A LONGER PERIOD IS REQUIRED BY NON-WAIVABLE LAW. Nothing excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.
13) Indemnification
You will indemnify and hold harmless Moonray, its affiliates, officers, employees, licensors, and partners from claims, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your breach of this Agreement or Platform terms; or (b) your misuse of the Game or violation of law.
14) Disputes
Governing Law. Texas, USA (conflict-of-laws rules excluded; UN CISG excluded).
Informal Resolution. Email info@moonray.studio and allow 30 days to resolve informally.
Arbitration (U.S. Residents). Binding individual arbitration under AAA Consumer Arbitration Rules; seat Texas. No class actions/class arbitrations. Jury trial waived.
Opt-Out. You may opt out within 30 days of first acceptance by emailing info@moonray.studio or mailing our address; if you opt out, we will not require arbitration.
Non-U.S. Residents. You may bring disputes in local courts to the extent required by non-waivable local law.
15) Export & Sanctions
You agree to comply with U.S. and local export/sanctions laws and represent you are not on a restricted-party list or in an embargoed country.
16) Region-Specific Consumer Terms (Minimal)
EEA/UK. Nothing here affects your mandatory consumer rights (e.g., legal guarantee of conformity). Sections 11–12 apply only to the extent allowed by applicable law.
Quebec (Canada). A French version will be made available if required by law.
17) Notices; Account Controls; Language
Account Hub (Link/Unlink/Delete): in-game text link and https://link.miiridianprime.services/. Deletion is irreversible.

Language: The English version controls; translations are for convenience only.
18) Changes
We may modify this Agreement; material changes will be reasonably noticed (e.g., in-game or on our website). Unless stated otherwise, changes take effect when posted; continued use means acceptance. Changes to dispute resolution/arbitration apply prospectively and do not affect disputes for which you have already provided notice.
19) Miscellaneous (Minimal)
Assignment. We may assign this Agreement (in whole or part) at any time; you may not assign it without our prior written consent.
Severability. If any provision is unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in effect.
No Waiver. A failure to enforce any provision is not a waiver.
No Third-Party Beneficiaries. Except as expressly stated in the Apple iOS Addendum, there are no third-party beneficiaries to this Agreement.
Entire Agreement. This Agreement is the entire agreement between you and us regarding the Game and supersedes prior or contemporaneous understandings.
Force Majeure. We are not liable for delay or failure due to causes beyond our reasonable control, including acts of God, war, terrorism, labor disputes, epidemics, or Internet/service outages.
Platform Addenda (Minimal, All Four Platforms)
A) PlayStation™ (Sony Interactive Entertainment)
This Agreement is between you and Moonray; SIE is not a party and has no obligation to provide maintenance/support.
You must comply with PlayStation™Network Terms of Service and the PSN Community Code of Conduct, in addition to the Miiridian Prime Code of Conduct.
To enable PSN features and cross-play, we may process your PSN Online ID, PSN account identifiers, region, and gameplay/session data per this Agreement and the Privacy Policy.
Product/IP claims concerning the Game are handled by Moonray, not SIE.
Use of system-level capture/stream must comply with this Agreement and PSN policies; we may restrict capture for certain segments.
B) Apple iOS (App Store)
This Agreement is between you and Moonray only; Apple is not a party and has no obligation to provide maintenance/support.
Use on iOS is also subject to the App Store Terms and the Usage Rules therein.
Product claims (including legal/regulatory conformity and consumer protection) and IP claims are handled by Moonray, not Apple.
You represent you are not located in an embargoed country and not on a U.S. restricted-party list.

Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
C) Google Play (Android)
Your use on Android is also governed by Google Play Terms of Service and applicable refund policies.
Google is not responsible for maintenance/support of the Game.
Where applicable, disclosures of in-app purchases/network features will be provided on the store page.
D) Steam (Valve)
Your use on Steam is also governed by the Steam Subscriber Agreement.
Valve is not responsible for maintenance/support of the Game.
Steam Wallet purchases/refunds (if enabled later) follow Valve policies and applicable law.
